1. Who these terms are between

These terms are between Fionn Murphy, trading as FMOps, a sole trader based in Waterford, Ireland ("FMOps", "we", "I"), and you, the person or business using this website or buying a service ("you", "the client"). Contact: fionn@fmops.ie · +353 86 107 2373.

By using the site, its free tools, or accepting a quote, you agree to these terms. Our privacy policy explains how we handle your data.

2. Services and scope

FMOps offers four services: AI search visibility, small business websites, business automation, and Claude for Small Business installs. Every project has a written quote or order confirmation that sets out the scope, price, timeline and anything specific to you. Work outside that scope is quoted separately and agreed in writing before it starts.

A contract starts when you accept the quote in writing (email is fine) or pay the first invoice, whichever comes first.

3. The free call and free tools

The free 30-minute call, the AI visibility check, the automation audit and ROI calculator, the Claude readiness quiz, and the website tier selector are free and carry no obligation on either side.

They are provided "as is" and for information only. Results are estimates or snapshots based on what you tell us and what AI models answered on the day. AI answers change without notice, so a check run tomorrow may differ. Nothing in a free tool or call is professional advice, and no result is a promise about the outcome of paid work.

4. AI search visibility

This is a monthly service with a fixed, capped scope described in your quote. It runs month to month. Either side can end it with 30 days' written notice; work done or invoiced up to the end date is payable.

We do not guarantee rankings, mentions, traffic or revenue. AI models and search engines change their answers without notice, and no one honestly controls what ChatGPT, Claude, Google, Perplexity or any other model says. What we commit to is the agreed work each month and a clear report of what changed.

5. Websites

Websites are one-off projects at the tier set out in your quote. Each tier lists what is included, such as number of pages and rounds of changes. You own your domain name, the site files, and the content once the final invoice is paid. We will hand over access and files on request.

An optional monthly care plan covers hosting, updates and small changes as described in the quote. You can cancel the care plan at any time; it stops at the end of the month already paid.

Text, images and other content you supply must be yours to use and must be lawful. You confirm you have the rights to anything you give us to publish.

6. Automation

Automation projects are quoted at a fixed price after a free audit. The quote sets out what is built, what tools are used and what "done" looks like. We fix defects in the delivered work free of charge for 30 days after launch. Changes to scope, or work caused by third-party tools changing, are quoted separately.

Subscriptions for third-party tools (for example Make, Zapier, Google Workspace, or an AI provider) are yours. You contract with those providers directly and pay them directly, unless the quote says otherwise.

7. Claude for Small Business

This service is a one-off setup fee plus a monthly fee, as set out in your quote. Claude licences are contracted and paid to Anthropic directly by you and are not included in our fees. We help you choose and set them up.

Any workflow we build that can act outside your business (for example sending an email, message or invoice) requires human approval before the outbound action, unless you ask us in writing to remove that step. Because this service involves handling your business data, we sign a data processing agreement (DPA) with you before we start.

8. Payment

• One-off projects (websites, automation, Claude setup): 50% deposit to start, balance at launch or hand-over, unless the quote says otherwise.
• Monthly services (AI search visibility, care plans, Claude monthly fee): invoiced monthly in advance.
• Invoice terms: all invoices are due within 14 days of the invoice date. Prices exclude VAT unless stated; VAT is added where it applies.
• Late payment: we may charge interest and compensation on late payments under the European Communities (Late Payment in Commercial Transactions) Regulations 2012, and we may pause work until the account is settled.

9. Intellectual property

Once you have paid in full, you own the deliverables made for you: pages, content, designs, workflows and configurations described in the quote. FMOps keeps ownership of its own tools, templates, methods, code libraries and know-how, and may reuse them for other clients. Third-party software and licences stay with their owners under their own terms.

10. Confidentiality

Each side keeps the other's non-public business information confidential and uses it only for the work. This does not cover information that is already public, or that must be disclosed by law. With your written consent, we may name you as a client and publish a testimonial or results.

11. Acceptable use

You may not use this site, its tools or our services for anything unlawful, to send spam, to harm others, or to try to break, overload or scrape the site. We may refuse or stop work that we reasonably believe is unlawful or harmful.

12. Liability

Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

Otherwise, FMOps is not liable for indirect or consequential loss, including lost profit, lost revenue, lost business or lost data. Our total liability to you for any claim under or in connection with a service is capped at the fees you paid to FMOps in the 3 months before the event giving rise to the claim. Free tools and the free call are provided without any warranty.

13. One business per trade per town

For AI search visibility, we work with one business per trade per town at a time, so we are never competing against our own clients. If your trade and town are already taken, we will tell you and may keep your details on a waiting list with your consent.

14. Termination

Monthly services can be ended by either side with 30 days' written notice, or immediately by either side if the other side seriously breaches these terms and does not fix it within 14 days of being told. One-off projects can be cancelled by you before delivery; the deposit is not refundable, and work done beyond it is invoiced. On termination you pay for work delivered or invoiced, and we hand over deliverables that have been paid for.

15. Governing law

These terms are governed by the law of Ireland. The courts of Ireland have exclusive jurisdiction over any dispute.

16. Changes to these terms

We may update these terms. The current version is on this page with the "Last updated" date. Changes do not affect a project already agreed under a written quote unless we both agree in writing.
